Cue — Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and Anish Karthik ("we", "us") governing your use of the Cue app ("the app"). By downloading or using Cue, you agree to these Terms. If you do not agree, do not use the app.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Cue on Apple devices you own or control, in accordance with these Terms and the Apple Media Services Terms and Conditions (including the standard Licensed Application End User License Agreement, the "Apple Standard EULA"). These Terms supplement, and where stricter than, the Apple Standard EULA prevail for app-specific matters; otherwise the Apple Standard EULA applies.

2. Subscriptions

Cue offers an optional auto-renewable subscription ("Cue Pro").

• Free tier. Without a subscription you may use a limited number of AI Auto shots per month. The current limit is shown in the app.
• Pro. A subscription unlocks expanded AI usage, subject to a fair-use cap shown in the app to prevent abuse.
• Pricing & billing. Prices are shown in the app before purchase (e.g. monthly and annual options). Payment is charged to your Apple Account at confirmation of purchase.
• Auto-renewal. Subscriptions renew automatically for the same period and price unless cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
• Managing & cancelling. You manage or cancel your subscription in your Apple Account settings (Settings → your name → Subscriptions). Deleting the app does not cancel a subscription.
• Free trials/offers, if any, convert to a paid subscription unless cancelled before the trial ends. Any unused portion of a free period is forfeited when you purchase a subscription.
• Refunds are handled by Apple under the Apple Media Services Terms; we generally cannot issue refunds directly.

3. Your content and acceptable use

• You are responsible for the photos and camera input you process with Cue. You represent that you have the rights to those images and the right to have them processed by our AI provider.
• You agree not to use Cue to process unlawful content, content depicting others without required consent, or content that infringes others' rights, and not to misuse, reverse engineer, scrape, or attempt to circumvent the app's usage limits or security (including App Attest).
• We may suspend or terminate access for violations.

4. AI features and disclaimer

Cue's guidance and edits are produced by automated AI models and are provided "as is." They are suggestions only; we do not guarantee that any recommendation, framing, setting, or edit is accurate, suitable, or error-free. You are responsible for the photos you take and keep.

5. Intellectual property

Cue, its software, branding, and design are owned by us and our licensors. These Terms do not transfer any ownership in the app. You retain all rights to the photos you create; we claim no ownership of your images.

6. Disclaimers

The app is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

7. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of Cue. Our total liability for any claim is limited to the amount you paid us for the app in the 12 months before the claim.

8. Termination

You may stop using Cue at any time. We may suspend or terminate the app or your access if you breach these Terms or to comply with law. Sections that by their nature should survive (e.g. 5–7) survive termination.

9. Changes

We may update these Terms; the "Last updated" date will change. Continued use after changes means you accept the updated Terms.

10. Apple-specific terms

You acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claims relating to the app, including product-liability, legal/regulatory, or intellectual-property claims.

11. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules, except where your local consumer law requires otherwise.
